What Makes Hawaii Different

Hawaii authorizes no lottery, no casinos and no sports betting. State law defines gambling as staking something of value on a contest of chance or a future event outside your control (HRS 712-1220), which covers nearly every bet a sports fan would make. The narrow exception is social gambling, and it is a defense in court rather than a license. It applies only when players compete on equal terms, nobody but the players profits, the game is not held in a business or public place, every player is an adult, and it is not bookmaking (HRS 712-1231).

Paid daily fantasy is out too. In January 2016 the Attorney General concluded that daily fantasy contests such as FanDuel and DraftKings are illegal gambling under Hawaii law, and DraftKings still lists Hawaii as an excluded region.

The Legislature keeps getting close on sports betting and then stopping. In 2025, HB 1308 passed the House on March 4 and the Senate, 15-10, on April 8. The House rejected the Senate's changes, conferees were appointed, and the bill carried over to 2026 with no further action. A 2026 version, HB 2570, cleared its first committee but drew 20 no votes on the House floor and stalled.

Prediction markets are the newest fight. HB 2198 would add prediction markets on sports, politics and other events to the penal code's definition of gambling. The House passed it on March 10, 2026 with no members voting no, but the Senate never heard it. For now, the gambling definition still excludes contracts for the future purchase or sale of securities or commodities.

The same session saw SB 3281, a crackdown on illegal electronic gambling devices, pass the Senate 25-0 before a House committee deferred it on March 18.

Hawaii has no neighboring states. Residents cannot legally bet on sports anywhere in the state.

Best Legal Options in Hawaii

  1. Private social games among adults: Hawaii law provides a social gambling defense for games among adults on equal terms in a private setting where no one but the players profits. It is an affirmative defense, not a license; it does not cover bookmaking, games in businesses or public places, or any game where someone takes a cut.
  2. CFTC-regulated prediction market exchanges: Federally regulated event contracts; Hawaii has not enacted a ban. The Hawaii House voted in 2026 to classify them as gambling, and their status under state law is contested nationally. Treat as unsettled.

Is Sports Betting Legal in Hawaii?

As of October 26, 2026, Hawaii does not offer legal online or retail sports betting. No legal gambling framework of any kind.

Are There Legal Betting Apps in Hawaii?

No. National sportsbook apps like FanDuel and DraftKings are licensed state by state, and none holds a Hawaii license, so their apps do not accept bets placed from Hawaii. Any site that does take your action is operating offshore and unregulated, with no consumer protection if a payout goes wrong.

That said, the absence of sportsbooks does not mean you have no legal options. Two regulated product categories work in most states without sports betting, and both are covered in depth on this site.

What Hawaii Bettors Should Know

Because there are no licensed sportsbooks operating in Hawaii, residents cannot legally place real-money sports wagers with a state-regulated operator. We strongly recommend avoiding unlicensed offshore sportsbooks: they operate outside U.S. consumer-protection law, offer no guarantee your funds or winnings are safe, and using them can carry legal and financial risk.

Some Hawaii residents follow legislative developments closely, since the legal landscape can change from session to session. Until a regulated market launches, the safest approach is to stick with the regulated alternatives above rather than unlicensed offshore sites.

When Could Hawaii Legalize Sports Betting?

Hawaii is one of only two states with no legal gambling of any kind, so sports betting would be a major policy shift. HB 1308 came closest: it passed both chambers in 2025 but died in conference in 2026, and a 2026 bill (HB 2570) stalled in committee.

There is no confirmed timeline. Legalization in any state requires legislation (and sometimes a voter referendum or tribal compact negotiations), followed by a regulatory rollout that can take months. We update this page whenever the status changes, so check back for the latest.
