Nebraska's November 3 Online Sports Betting Vote
Nebraska voters decide two linked measures on November 3, 2026. Initiative 440 would amend the state constitution (Article III, section 24) so that laws on racetrack casino gaming may include online sports betting when the bettor is in Nebraska. Initiative 441 would write the rules: each licensed racetrack casino could offer online betting on its own or through no more than two platform providers, servers would have to be in Nebraska, and the existing limits on bets involving Nebraska college teams would stay.
The official ballot question for Initiative 440 asks: "Shall the Nebraska Constitution be amended to authorize the enactment of laws allowing persons located within Nebraska to place sports wagers through an Internet-based platform when offered by an authorized gaming operator conducting games of chance within a licensed racetrack enclosure in Nebraska?" The Secretary of State certified both measures for the ballot on August 21, 2026.
If both pass, the statutory measure becomes operative on January 1, 2027, and regulators have until June 1, 2027 to adopt rules, so online betting would not start before 2027. Until then, legal sports betting in Nebraska stays in person at licensed racetrack casinos. We update this page with the result the morning after the vote.

Could Nebraska Add Statewide Mobile Betting?
Nebraska approved retail betting at licensed racinos, and lawmakers have debated adding statewide mobile, most recently falling short of the votes needed to put the question to voters. Supporters then gathered signatures instead, and two measures to legalize and regulate online sports betting are on the November 3, 2026 ballot. If voters approve both, the law takes effect January 1, 2027, with state rules due by June 1, 2027.
